Privacy Policy

Information we collect

We collect information in three ways: what you give us directly, what your browser sends automatically, and what clients share with us during an engagement.

  • Information you provide. When you fill in our contact form, request a call, or email us, we receive the details you enter, such as your name, email address, company name, phone number, the service you are interested in, and anything you write in your message.
  • Information collected automatically. Like most websites, our servers and analytics tools record your IP address, browser type, device type, operating system, referring page, the pages you view, and the date and time of each visit. See the Cookies section below.
  • Client and project information. If you become a client, we may receive business contact details, website credentials, advertising and analytics account access, brand assets, customer lists for campaigns, and other material you choose to share so we can deliver the work.

How we use information

We use the information we collect to:

  • Respond to your inquiry, schedule calls, and send proposals you have asked for.
  • Deliver, manage and improve the services you have engaged us for.
  • Operate, secure and improve our website, including understanding which pages are useful.
  • Send occasional updates about our services if you have opted in. You can unsubscribe at any time.
  • Comply with legal obligations, enforce our agreements, and protect our rights and the rights of others.

We do not sell your personal information, and we do not use it for automated decisions that have legal effects on you.

Cookies and analytics

Our website may use cookies and similar technologies, such as pixels and local storage, to remember your preferences, understand how visitors use the site, and measure the performance of our own marketing. This may include tools such as Google Analytics, which set their own cookies and process data under their own privacy policies.

You can control cookies through your browser settings, including blocking or deleting them. Some parts of the site may not work as intended if cookies are disabled. Where required by law, we will ask for your consent before setting non-essential cookies.

How we share information

We share information only in the following circumstances:

  • Service providers. We use trusted third parties to host our website, deliver email, store files, and run analytics. They may process your information only on our instructions and for the purposes described in this policy.
  • Advertising and platform partners. When delivering client campaigns, we work inside platforms such as Google, Meta and other advertising, search and social networks. Data shared with those platforms is governed by their terms and the client's own agreements with them.
  • Legal requirements. We may disclose information if required by law, subpoena or court order, or if we believe disclosure is necessary to protect the safety, rights or property of any person, or to investigate fraud or security issues.
  • Business transfers. If we merge with, are acquired by, or sell assets to another company, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your information.

Data we handle for clients

In the course of delivering websites, SEO, social media and advertising work, we often process data on behalf of our clients, such as their customer lists, form submissions, or analytics. In those cases the client is responsible for that data and we act on their instructions. We use it only to perform the agreed work, keep it confidential, and return or delete it when the engagement ends unless we are required to keep it.

Data retention

We keep inquiry and contact information for as long as needed to respond to you and for a reasonable period afterwards in case you return. Client and project records are kept for the length of the engagement and for as long as required for accounting, tax, legal and contractual purposes, typically up to seven years. Analytics data is retained according to the settings of the analytics tool in use. When information is no longer needed, we delete or anonymise it.

Security

We take reasonable technical and organisational measures to protect your information, including encrypted connections, access controls, and secure handling of client credentials. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you as required by law.

Your choices and rights

Depending on where you live, you may have the right to:

  • Ask what personal information we hold about you and receive a copy.
  • Ask us to correct or delete your personal information.
  • Opt out of marketing emails using the link in any message or by contacting us.
  • Object to or restrict certain processing, or ask that we not sell or share your information. We do not sell personal information.

To exercise any of these rights, email hello@painitemarketing.com. We will verify your identity before acting on a request and respond within the time required by applicable law. We will not treat you differently for exercising your rights.

California residents. If you are a California resident, the California Consumer Privacy Act (CCPA) gives you the rights described above, including the right to know, delete, and correct, and the right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under the CCPA.

Children's privacy

Our website and services are intended for businesses and are not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it.
